In most inheritance cases, the order of succession is clear. It is either based on the statutory succession or on the discretionary succession (will or inheritance contract). However, there are also a large number of cases in which the order of succession is not clear. This can be the case, for example, if several (contradictory) wills exist or if there are doubts about the testator's testamentary capacity. In these cases, the succession must be clarified in court. There are two ways to do this.
